Please read these terms carefully before placing an order
1Scope of Agreement
These Terms and Conditions (the "Agreement") apply to all sales of livestock, plants, and goods conducted via justkeepshrimping.com. By placing an order, the purchaser (hereafter "The Buyer") acknowledges they are entering into a legally binding contract with Sanjin Blazinic (trading as Just Keep Shrimping), a DAFM-registered Pet Trader (Registration No: DPT200351C).
This Agreement is governed by the laws of Ireland, specifically the Consumer Rights Act 2022 and the European Union (Animal Health Law) Regulations. This document constitutes the entire agreement between the Seller and the Buyer. Any prior informal communications, whether via social media or email, are superseded by these terms. By completing a purchase, the Buyer confirms they have the necessary knowledge and equipment to provide an environment that meets the animal welfare requirements of the species provided.
2Shipping Policy
2.1 Appointment-Only Collection
Just Keep Shrimping is a private breeding facility and is not open to the general public. Collection of livestock and goods is strictly by prior appointment only at our designated premises in Cork City.
2.2 Inspection at Collection
The Buyer is encouraged to inspect all livestock and goods at the time of collection. By accepting and leaving the premises with the livestock, the Buyer confirms that the animals were received alive, in good condition, and substantially matching the description provided at the time of sale.
2.3 Transfer of Risk and Ownership
Legal ownership and risk in the livestock transfer to the Buyer immediately upon physical handover at the Seller’s premises. The Seller accepts no liability for injury, loss, stress, illness, or death occurring after collection, including during transport or acclimation.
2.4 Buyer Transport Responsibility
The Seller is solely responsible for ensuring suitable transport conditions during their journey home, including maintaining appropriate temperature stability and minimising transit stress to the livestock.
2.5 Welfare Override
In compliance with DAFM animal welfare standards, the Seller reserves the right to refuse or postpone collection and shipment if environmental conditions or transport arrangements are considered unsafe for the livestock.
3Collection and Inspections
3.1 Shipping Service
Just Keep Shrimping offers livestock shipping exclusively through UPS Approved Live Animal Services. Shipping is arranged directly by the Seller as part of the Buyer’s order.
3.2 Transfer of Risk
In accordance with Section 35 of the Consumer Rights Act 2022, risk in the livestock transfers to the Buyer at the time the shipment is delivered to the address provided during checkout.
3.3 Professional Packaging Service
To maximise livestock safety during transit, all shipments include a professional packaging service fee. This service includes:
Insulated, water-resistant shipping containers.
Climate-control packs (Heat or Cool) selected according to seasonal conditions.
Scientifically managed packing densities designed to minimise transport stress.
3.4 Live Arrival Guarantee (LAG)
The Seller provides a Live Arrival Guarantee for livestock shipped via UPS, subject to the following conditions:
The Buyer must inspect the shipment immediately upon arrival. Any claim for deceased or damaged livestock must be submitted within two (2) hours of the recorded delivery time and must include clear photo or video evidence showing the livestock inside the original, unopened transit bag.
Opening the bag, acclimating the livestock, or exceeding the two-hour reporting window immediately voids the Live Arrival Guarantee, as the Seller can no longer verify the transport conditions or livestock status at the time of delivery.
Approved claims may result in replacement livestock or store credit at the Seller’s discretion. Shipping fees are non-refundable.
3.5 Buyer Weather Responsibility
By placing an order, the Buyer confirms that local weather conditions at the delivery location are expected to remain within the safe shipping range of 8°C to 28°C on the delivery date.
The Seller reserves the right to delay shipment where extreme weather conditions may endanger livestock welfare during transit.
3.6 Welfare Override
In compliance with DAFM animal welfare standards, the Seller reserves the right to postpone or reschedule any shipment where temperature extremes, courier disruption, or other environmental factors present a significant risk to livestock survival.
3.7 Claims for Incorrect Items
Any claim regarding incorrect species or quantities must be supported by clear photos or video of the livestock in the original, unopened, and sealed transport bags within two (2) hours of the recorded delivery time. Once a bag has been opened, the contents and condition can no longer be independently verified, and any entitlement to a remedy is forfeited.
4Cancellation Policy
4.1 General Right to Cancel: In accordance with Irish consumer law, the Buyer has a right to cancel an order for non-perishable equipment or dry goods within 14 days of receipt. For livestock and perishable biological goods, the following specific terms apply due to the nature of the product.
4.2 Pre-Packing Cancellation: The Buyer may cancel an order for a full refund at any time before the livestock has been caught, sorted, and staged for transport. To ensure a refund, cancellation requests must be received via [Your Contact Email] at least 24 hours prior to the scheduled collection or courier handover time.
4.3 Post-Packing / "In-Transit" Cancellation: Once livestock has been packed into transport containers (bags, insulated boxes, etc.), the order is considered final. Due to the high stress of the packing process and the limited life-support capacity of transport water, we cannot offer refunds for "change of mind" cancellations once the animals have been staged for handover.
4.4 Exceptions to the Cooling-Off Period: The Buyer acknowledges that live animals are "perishable goods" and "goods that are liable to deteriorate or expire rapidly." Therefore, the statutory 14-day cooling-off period does not apply to livestock once they have left our premises.
4.5 Order Modifications: If the Buyer wishes to add to or modify an existing order, they must do so at least 48 hours before the scheduled collection. While we will make every effort to accommodate changes, we cannot guarantee the availability of specific lineages at short notice.
4.6 Refund Processing: All valid refunds for cancelled orders will be processed within 14 days using the original payment method.
5Biological Disclaimer & Post-Release Liability
5.1 Acclimation & Environment: The Buyer acknowledges that livestock and plants are highly sensitive to changes in water chemistry (pH, GH, KH, TDS, and Temperature). It is the Buyer's sole responsibility to ensure their aquarium is fully cycled, matured, and chemically appropriate for the species purchased. While Sanjin Blazinic T/A Just Keep Shrimping provides a recommended acclimation guide, the Trader cannot monitor or guarantee its execution and therefore accepts no liability for losses occurring during or after the acclimation process.
5.2 Post-Release Liability: Once livestock or plants have been introduced into the Buyer’s aquarium, the Trader accepts zero responsibility for their continued health, survival, or behavior. The introduction of live animals into a new environment involves variables—including but not limited to predation, improper parameters, osmotic shock, or pre-existing pathogens—that are entirely beyond the Trader's control.
5.3 Biosecurity & Quarantine: Trader Standard: The Trader maintains high-level biosecurity and health standards within our facilities.
Buyer Responsibility: In line with best practices for DAFM-registered transactions, the Buyer is responsible for their own biosecurity protocols. We strongly recommend a quarantine period for all new arrivals before they are introduced to established "main" tanks.
Impact Disclaimer: The Trader is not liable for any secondary impact (e.g., stress, disease transmission, or territorial aggression) that the new livestock may have on the Buyer's existing aquatic inhabitants.
6Phenotypic Variation
6.1 Natural Variation > Living organisms are biological entities, not mechanical products. Natural variations in size, color intensity, and pattern are inherent to the species and do not constitute a product fault or a lack of conformity.
6.2 Coloration & Stress Factors > The physical appearance of Neocaridina is highly reactive to environmental factors, including stress, substrate color, lighting, and water chemistry (specifically TDS and GH). The Buyer acknowledges that shipping or moving livestock frequently causes temporary "paling" or a significant loss of color intensity. High-grade coloration typically returns only once the specimen has acclimated to a stable, mature environment.
6.3 Subjectivity of Grading > "Grade" (e.g., Painted Fire Red, Blue Dream) is a subjective hobbyist classification and not a fixed technical specification. While the Trader (Sanjin Blazinic T/A Just Keep Shrimping) maintains a rigorous culling program to ensure high genetic standards, the Trader does not guarantee that every individual specimen will meet a Buyer's personal interpretation of a specific grade.
7Consumer Rights & Statutory Exemptions
7.1 Mandatory DAFM Registration: Just Keep Shrimping is a DAFM-registered Seller of Pet Animals (Registration No: DPT200351C). In accordance with the Animal Health and Welfare (Sale or Supply of Pet Animals) Regulations 2019, the Trader is legally required to maintain a "Register of Sales" for all livestock transactions.
7.2 Data Collection & Retention: For every sale of livestock, the Trader must record the following information:
Name and address of the purchaser.
Date of sale/supply.
Description of the animal (species, color, health status).
These records must be retained by the Trader for a period of no less than three (3) years and must be made available for inspection by an authorized DAFM officer upon request.
7.3 GDPR & Legal Basis for Processing: Under the General Data Protection Regulation (GDPR), the legal basis for processing this personal data is "Compliance with a Legal Obligation" (Article 6(1)(c)). Consequently, while the Buyer retains their other data rights, the "Right to Erasure" cannot be exercised regarding the information contained in the statutory Register of Sales until the mandatory three-year retention period has expired.
7.4 Privacy Commitment: All personal data is stored securely and will never be shared with third parties for marketing purposes. Data is only shared with statutory authorities (DAFM/Local Authorities) when required by law.
8Dispute Resolution
8.1 Amicable Resolution > Sanjin Blazinic T/A Just Keep Shrimping is committed to scientific integrity and customer satisfaction. In the event of a disagreement regarding the health, species, or quality of an order, the Buyer agrees to first contact the Trader directly via email to seek an amicable resolution through documented messaging.
8.2 Jurisdiction > This agreement is governed by the laws of the Republic of Ireland. Any legal proceedings arising from this contract that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the Irish Courts.
8.3 Small Claims Procedure > As the Seller is a DAFM-registered pet trader, the Buyer may avail of the Small Claims Procedure in the District Court for any qualifying claims (currently up to €2,000). This provides an accessible and inexpensive method for resolving consumer disputes without the requirement for a solicitor.
8.4 Fraud and Chargebacks
The Seller reserves the right to refuse service, terminate accounts, or permanently block future transactions from any individual, phone number, physical address, or Eircode associated with fraudulent activity, malicious chargebacks, or unverified payment disputes.
